Reported 3 Nov 2026 · Governance A one-minute read

A São Paulo judge barred Meta from training AI on Brazilian news content.

The November 3 injunction suspends the clause tying platform access to free scraping, under a penalty of 1 million reais a day. Caveat: it is preliminary, and reached us a day late.

Until now

Publishers could refuse AI scraping only by leaving the platforms.

Now

A court can suspend the trade and keep the accounts open.

Why it matters

Meta's new business terms made account access conditional on free scraping, due to take effect November 20. The judge called that a manifest abuse of rights and froze it before hearing Meta. Britain's competition regulator opened a case on the same terms days earlier. Two jurisdictions now treat the bargain itself as the problem.

Established

  • A preliminary injunction issued November 3 without Meta being heard first.
  • The daily penalty is 1 million reais, capped at 100 million.
  • Meta has 5 days from service to contest the order.

Not established

  • Any final ruling. The main action has not been filed yet.
  • How many outlets are covered. No count is published.
  • That Meta will change the same terms in other markets.

The record

Reported, not verified. This is a preliminary order in a Brazilian state court and we could not read the decision itself: the São Paulo docket for case 4214874-21.2026.8.26.0100 is not fetchable from here. The account rests on PPC Land, which quotes the decision at length, with Agence France-Presse through The Star and Malay Mail. The dated verification event: by December 5, the decision text at tjsp.jus.br, a Meta statement, or a filing by one of the associations.

Judge Guilherme Madeira Dezem of the 44th Civil Court of the Central Civil Forum in São Paulo signed a preliminary injunction on November 3, 2026 at 15:36 local time, which is 18:36 Universal Time, in case 4214874-21.2026.8.26.0100. He granted it without hearing Meta. The applicants are 3 trade bodies acting for their members: the Brazilian Association of Radio and Television Broadcasters, the National Association of Newspapers and the National Association of Magazine Publishers. The defendant is Facebook Servicos Online do Brasil Ltda. The order suspends, until final judgment, the effectiveness of the final part of Clause 1 of Meta's updated Commercial Terms, together with any provision making access to accounts conditional on authorising scraping. It requires Meta to keep members' accounts on Instagram, Facebook, WhatsApp and Threads fully active, intact and in normal operation, with no retaliation for refusing the new terms. It bars Meta from crawling members' domains with automated tools and from using that content to train or feed Meta AI. The penalty for non-compliance is a daily fine of 1 million reais, about $180,000 at the rate reported, capped at 100 million reais. The judge described the conditional bargain as a manifest abuse of rights. Meta's new business terms were due to take effect on November 20. Meta has 5 days from service to contest the order, and the associations have 30 working days from enforcement to file the main action. Meta had not responded to Agence France-Presse at the time of publication. Marcelo Rech, executive president of the National Association of Newspapers, is quoted for the applicants. Not established: how many outlets are covered, the reasoning beyond the quoted passages, and whether Meta will comply or appeal.

How it got here

  1. Oct 30

Britain's Competition and Markets Authority opens an abuse of dominance case over the same Meta terms for using publishers' content. Edition 067.

  2. Nov 3

The Sao Paulo injunction issues at 15:36 local time, without Meta being heard, 17 days before the terms were due to take effect.

  3. Nov 3

The same day, an Advocate General tells the Court of Justice of the European Union that training is in principle lawful but answers can infringe. Edition 072.

  4. Nov 4

Coverage reaches us through Agence France-Presse and PPC Land, a day after the event, which is why this card is dated November 3 and says so.

  5. Nov 20

The date Meta had set for the revised commercial terms to take effect, already moved once after engagement with the British regulator.

Who has to react

Meta, with 5 days to answer; the 3 Brazilian associations and their members; the British competition regulator, holding the same terms in another forum; publishers in every country offered the same bargain; and Brazil's data protection authority, which has restrained Meta before.

What to watch

  • Would strengthen itMeta withdraws or amends the scraping clause in its commercial terms for a market beyond Brazil, or another national court or regulator restrains the same terms, by March 31, 2027.
  • Would weaken itA Brazilian appellate court suspends or vacates the injunction, or the terms take effect in Brazil on November 20 as written, by December 31, 2026.

Why it weighs this much

Signal strength
CostLow
CommitmentHigh
ReversibilityModerate
PersistenceMonths

Cost is low to the court and real to Meta: the fine accrues daily and the terms it was about to impose in Brazil are frozen. Commitment is high, because a signed judicial order carrying a daily penalty is not a position a party can quietly abandon, and Meta must comply or contest inside 5 days. Reversibility is moderate: preliminary injunctions are routinely narrowed or lifted on appeal, and this one was granted without hearing the defendant, which is the usual ground for review. Persistence is months, until final judgment or an appellate ruling.

The words

Preliminary injunction
An order freezing something before the case is decided, granted when waiting would cause harm that cannot be undone.
Scraping
Automated copying of a website's pages. Here it is what Meta's terms asked publishers to permit for free.
Manifest abuse of rights
A civil law doctrine: using a legal right in a way the law will not protect. The judge's stated ground for the order.
